These Terms & Conditions apply to all orders placed on silvie.health and to the use of this website.

Throughout these Terms, “Silvie”, “Silvie Health”, “we”, “us” and “our” refer to TRSD Group BV. “You” refers to the customer or website visitor.
By placing an order through our website, you agree to these Terms. Please read them carefully before ordering.
1. About our products
Silvie Health sells food supplements and nutrition products designed to support general wellbeing, physical performance, and healthy daily routines.
Our products are food supplements. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease. Information on our website is provided for general informational purposes only and should not be seen as medical advice.
If you are pregnant, breastfeeding, taking medication, have a medical condition, or are unsure whether a product is suitable for you, please consult a doctor, pharmacist, dietitian, or other qualified healthcare professional before using our products.
Food supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle.
2. Eligibility to order
By placing an order, you confirm that:

you are purchasing products for personal use, unless we have agreed otherwise in writing.
We reserve the right to refuse or cancel orders if we reasonably believe that an order is fraudulent, placed for unauthorized resale, or otherwise violates these Terms.
3. Product information
We try to display product descriptions, ingredients, nutritional information, prices, images, availability, and other information as accurately as possible.
However, minor differences may occur. Product packaging may differ slightly from images shown on the website. The information on the physical product label should always be followed.

4. Prices and taxes
All prices are shown in the currency displayed at checkout.
For customers in the European Union, prices include VAT where applicable, unless clearly stated otherwise.
For customers outside the European Union, the price shown at checkout may not include import duties, customs charges, local taxes, or other fees charged by the destination country. These charges are your responsibility unless expressly stated otherwise at checkout.
We reserve the right to change prices at any time. Price changes do not affect orders that have already been accepted by us.
5. Orders and order acceptance
After placing an order, you will receive an order confirmation by email. This means we have received your order.
A binding purchase agreement is formed when we accept your order. We may accept your order by sending a shipping confirmation, starting fulfilment, or otherwise confirming acceptance.
We may cancel or refuse an order if:

the product is unavailable;

payment is not authorized;

the order appears fraudulent or suspicious;

there is an obvious error in the price or product information;

we are unable to deliver to your location;

legal or regulatory restrictions prevent us from fulfilling the order.
If we cancel an order after payment has been taken, we will refund the amount paid.
6. Payment
Payment must be made using one of the payment methods offered at checkout.
Payments are processed by third-party payment providers. We do not store your full payment card details.
Your order will only be processed after payment has been authorized, unless we have expressly agreed otherwise.
7. Shipping and delivery
Shipping options, estimated delivery times, costs, and countries we ship to are explained in our Shipping & Returns Policy.
Delivery times are estimates and are not guaranteed unless expressly stated otherwise. Delays may occur due to carrier issues, customs checks, high order volumes, public holidays, force majeure events, or other circumstances outside our reasonable control.
You are responsible for providing a complete and correct delivery address. If an order cannot be delivered because the address is incorrect or incomplete, additional shipping costs may apply.
Risk of loss or damage passes to you when you or a person designated by you, other than the carrier, physically receives the products.
8. Right of withdrawal and returns
If you are a consumer in the European Union, you generally have the right to withdraw from your purchase within 14 days after receiving your order, without giving a reason.
The conditions, procedure, exceptions, and refund rules are explained in our Shipping & Returns Policy.
For health protection and hygiene reasons, sealed food supplement products cannot be returned once they have been opened or unsealed after delivery, unless the product is faulty, damaged, incorrect, or otherwise not in conformity with the contract.
This does not affect your statutory rights if a product is faulty, damaged, incorrect, or not in conformity with the contract.
9. Statutory consumer rights
If you are a consumer, you have statutory rights under applicable consumer protection law. These rights may include remedies if a product is faulty, damaged, incorrect, or not in conformity with the contract.
Nothing in these Terms, our Shipping & Returns Policy, or any other policy limits or excludes your mandatory consumer rights.
If you believe there is a problem with a product you received, please contact us at info@silvie.health as soon as reasonably possible and include your order number, a description of the issue, and photographs where relevant.
10. Subscriptions
Silvie subscriptions provide a discounted price in exchange for a minimum commitment period, shown clearly on the product page and at checkout before you place your order (for example, 3 months or 6 months). The minimum commitment, the price per delivery, the delivery frequency, and the total cost over the commitment period are all displayed before purchase.
Once you have placed a subscription order, you commit to receiving and paying for all deliveries within the minimum commitment period. You cannot cancel your subscription during the commitment period to avoid these charges, because the discounted price is conditional on completing the full term.
Your statutory 14-day right of withdrawal still applies to the first delivery: you may cancel your subscription and return the first, unused delivery within 14 days of receiving it. If you exercise this right, your subscription is cancelled in full and no further deliveries will be sent or charged.
After the minimum commitment period ends, your subscription will automatically renew on a monthly basis at the standard subscription price, unless you cancel. After the commitment period, you may cancel at any time before the next billing date through your account or by contacting info@silvie.health, and no further deliveries will be sent or charged.
If a delivery within your commitment period has already been processed or dispatched before you contact us, that delivery may still be sent and charged.
We may, at our discretion, allow earlier cancellation in exceptional circumstances (for example, medical reasons or a confirmed adverse reaction to the product). Please contact us at info@silvie.health if you believe such circumstances apply to you.
If a subscription order has already been processed or dispatched before cancellation, that order may still be delivered and charged. Your withdrawal and return rights remain as described in our Shipping & Returns Policy.
We may change subscription prices, products, or terms in the future. If a change materially affects your subscription, we will notify you in advance and explain your options.
If a payment fails, we or our payment provider may retry the payment. If payment continues to fail, we may pause or cancel the subscription.
11. Pre-orders and reservations
We may offer products for pre-order or reservation before they are available for dispatch.
If you place a pre-order, the estimated shipping date will be shown on the product page, at checkout, or in our communications with you. Estimated shipping dates are not guaranteed and may change.
If a material delay occurs, we will inform you where reasonably possible. If you do not want to wait, you may cancel the pre-order and request a refund unless the product has already been dispatched.
Specific pre-order or reservation terms may apply and will be shown at the time of purchase.
12. Discount codes and promotions
Discount codes, offers, and promotions are subject to the conditions stated at the time of the offer.
Unless stated otherwise, discount codes:

cannot be combined with other offers;

cannot be exchanged for cash;

may be limited to certain products, customers, countries, or time periods;

may be withdrawn or changed at any time before use.
If a discount code is used incorrectly or fraudulently, we may cancel the order or request payment of the correct amount.

You agree not to misuse our website. You must not:

attempt to gain unauthorized access to systems, accounts, or data;

copy, scrape, or extract website content in a way that harms us or violates applicable law;

We may suspend or restrict access to the website if we reasonably believe these Terms have been violated.
14. Intellectual property
All content on this website, including text, images, graphics, logos, product names, design, layout, videos, and other materials, is owned by or licensed to us and is protected by intellectual property laws.
You may use the website for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, sell, or use our content for commercial purposes without our prior written permission.
15. Reviews, comments, and user content
If you submit a review, comment, photo, testimonial, or other content to us or through our website, you confirm that the content is truthful, lawful, and does not infringe the rights of others.
You grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, publish, translate, and display that content for our business purposes, including on our website, social media, advertising, and marketing materials, unless prohibited by law or agreed otherwise.
We may refuse, remove, or edit user content if we reasonably believe it is unlawful, misleading, offensive, irrelevant, or otherwise inappropriate.

16. Health and nutrition information
Any health, nutrition, ingredient, or lifestyle information provided on our website, blog, emails, social media, packaging, or other materials is for general educational purposes only.
Although we aim to base our content on credible sources, nutrition science evolves and individual needs differ. You should not rely on our content as a substitute for professional medical advice, diagnosis, or treatment.
Always read the product label before use and follow the recommended daily intake. Do not exceed the recommended daily intake unless advised by a qualified healthcare professional.
Keep products out of reach of young children.
17. Limitation of liability
We are responsible for losses that are a foreseeable result of our breach of these Terms or our negligence, subject to applicable law.
We are not responsible for losses that were not foreseeable, losses caused by events outside our reasonable control, or business losses if you purchased products as a consumer for personal use.
Nothing in these Terms limits or excludes liability where this would be unlawful, including liability for death or personal injury caused by negligence, fraud, intentional misconduct, statutory product liability, or your mandatory consumer rights.
To the maximum extent permitted by law, our total liability for any claim relating to an order is limited to the amount paid for that order.
18. Force majeure
We are not responsible for failure or delay in performing our obligations where this is caused by circumstances outside our reasonable control. This may include natural disasters, war, terrorism, strikes, transport disruptions, pandemics, epidemics, government measures, customs delays, supplier failures, power outages, internet failures, or carrier disruptions.
If such an event affects your order, we will try to contact you as soon as reasonably possible.

We process personal data in accordance with our Privacy Policy.

20. Changes to these Terms
We may update these Terms from time to time. The latest version will always be available on our website.
The Terms that apply to your order are the Terms in force at the time you place the order, unless a change is required by law or regulatory authority.
21. Governing law and disputes
These Terms are governed by the laws of the Netherlands.
If you are a consumer, this choice of law does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.
If a dispute arises, please contact us first at info@silvie.health so we can try to resolve it directly.
If you are a consumer in the European Union, you may bring proceedings in the competent courts under applicable consumer protection rules. We may bring proceedings against you only in the courts permitted by applicable law.
For business customers, the courts of Amsterdam, the Netherlands, have exclusive jurisdiction, unless mandatory law provides otherwise.
